When such burden exists, the employee shall not be required to work unless his/her absence would cause the Agency to be unable to meet its responsibilities. When such an assignment is a burden to the employee, the Agency agrees to attempt to assign it to another employee or cancel the assignment. Tour Workers who choose to bank overtime may later re-elect to receive the deferred one-half premium pay.ĭistribution of Overtime Overtime work assignments shall be distributed as equally as is feasible among employees in the work unit who normally do the particular type of work needed. If equivalent time off is not taken by the end of the contract year following the contract year in which it is earned, the Company shall pay the deferred one-half premium pay.
Any overtime remaining at the end of the contract year in which it is banked may be carried over to the next contract year for purposes of taking equivalent time off. Sharing of Overtime Overtime work shall be allocated equitably to qualified employees considering their availability and location.īanking of Overtime (i) Tour Workers who work in excess of eight (8) consecutive hours shall have the option of receiving the overtime premium on the basis of this Section or of receiving straight time for hours in excess of eight (8) consecutive hours and taking equivalent time off in units of not less than four (4) hours at the hourly rate for the job when the work was performed, at a time suitable to the employee and the Company during the contract year. No overtime is to be worked without the prior authorization of management except in emergent situations necessary to effect Agency services. Notice of Overtime The Agency shall give as much notice as possible of overtime to be worked. Compensatory time may be paid off quarterly at the option of the Employer. Compensatory time accrued by employee choice may accumulate to a maximum of one-hundred twenty (120) hours. In the event budgetary or staffing limitations exist, in fact, and the Agency so notifies the employee in writing of the fact, with a copy to the Union, the Agency may designate the form of overtime compensation. All eligible employees who work overtime shall be compensated for authorized overtime, either in the form of cash or compensatory time off to be determined by the employee. Payment of Overtime Payment of overtime shall be included in the payroll paid on the first of the month following the pay period in which overtime is worked if the overtime is reported prior to the payroll cut-off date. Overtime shall not be paid twice for the same hours. Payment for Working Overtime on a Holidayĭaily Overtime A) All work in excess of the regularly scheduled work day as specified in Section 2105.51 Work Schedules shall be overtime and compensated at the rate of time and one-half (1-1/2) the regular rate or as otherwise provided.
